ARTICLE I
POLICY STATEMENT
By virtue of Article IX, Section 9.1.m. of the Declaration and Article III, Section 3.2.b. of the Bylaws, the Executive Board is empowered to adopt and amend reasonable rules and regulations, that are not in conflict with the provisions of the Declaration, concerning the use and enjoyment of the Property. Upon adoption or amendment, the Executive Board is required to furnish copies of the Rules and Regulations, and any amendments to all Unit Owners promptly after the adoption of same.
The purpose and intent of the Rules and Regulations stated herein are to provide a secure and pleasant environment for all residents of The Meadows, as well as to maintain and enhance the aesthetics, condition, and value of The Meadows property. Adherence to the Rules and Regulations, as a minimum standard of conduct, is required from all Owners, residents, and occupants and enforcement of the Rules and Regulations with respect to the tenant residents, shall be the responsibility of the respective Owner.
ARTICLE II
ENFORCEMENT
Each Unit Owner, resident, occupant and/or guest shall be governed by and shall strictly comply with the terms, provisions, conditions and restrictions set forth in the Declaration, Bylaws and Rules and Regulations.
The Executive Board has the right to enforce, by any procedure at law or in equity, all restrictions and covenants contained in the Declaration, Bylaws and these Rules and Regulations in accordance with the procedure set forth in Article II hereof.
Complaints of any violation of the Declaration, Bylaws and Rules and Regulations stated herein must be reported, in writing, to the Meadows Management Office as soon as possible. Please use REPORT ISSUE form, Appendix A-1
The Manager, as authorized by the Executive Board, or the Executive Board will make an investigation and evaluate the complaint to determine if the complaint is justified and if a violation exists, and will attempt to address the matter on a confidential basis when possible. This determination shall be at the Executive Board’s sole discretion
When an authorized person determines that a violation exists, a warning/reminder letter will be sent to the offending party, specifying the nature of the violation, and, if appropriate, requesting a correction within a specified period of time.
If a violation continues after notification and the time period for correction, as specified above, a second letter (violation letter) will be sent advising the violator that the appropriate rules violation assessment (fine) has been levied and/or legal action may ensue if the violation is not corrected. Violation assessments are recorded in the unit owner’s account. Included in the violation letter will be the right to appeal the violation and request a hearing before the Executive Board, if requested in writing within ten (10) days of receipt of the violation letter.
The Executive Board will review any appeal and schedule a hearing within thirty (30) days of receipt of the request for a hearing/appeal. Daily violation assessments shall continue to accrue pending any such appeal, as long as the condition that created the violation continues to exist.
In the event that a violation is not corrected despite the imposition of fines, the Executive Board may take legal action to obtain payment of the fine and/or compliance with the Declaration, Bylaws and or Rules and Regulations. The Executive Board may resort to filing immediate legal action for injunctive relief or damages if the circumstances warrant. The following costs will be assessed: enforcement costs, including the court costs, attorney’s fees, etc. Fines are collected in the same manner as assessments, and constitute a lien on the Unit.
In the event of a violation of the Declaration, Bylaws and/or Rules and Regulations, the Executive Board may suspend membership privileges, i.e., use of Common Elements, after notice and an opportunity to be heard.
Executive Board may exercise any and all of its rights as permitted by law and its decision is final.
Fines may include:
Escalating Fine (“ESC”): The violator will be assessed $50 for the first offense, $100 for the second same offense, $150 for the third occurrence, etc.
Daily Fine: The violator will be assessed an automatic $50 plus $25 per day for each day a violation continues after the initial $50 assessment has been levied.
Special Fine: as specified in these Rules and Regulations
ARTICLE III
RULES & REGULATIONS
Section 1. GENERAL CONDUCT
Each Unit Owner is responsible for the actions, conduct, and noise of their family members, guests, residents and tenants in full and complete compliance with the Declaration, Bylaws and Rules and Regulations. Each Unit Owner shall ensure that their tenants have been informed of the Meadows Declaration, Bylaws and Rules and Regulations. ESC
Unit Owners are responsible for all damage to Common Element areas, shrubbery, trees, and grounds caused by themselves, their occupants, tenants, residents, guests and/or pets and such persons shall assume the expense of any and all repairs. ESC
All Common Element areas, including laundry facilities, and entranceways shall be utilized and maintained by all residents in a sanitary manner and with respect and courtesy to their neighbors. There shall be no smoking in the laundry facilities. Laundry facilities are to be used during the hours of 7:00 a.m. and 10:00 p.m. ONLY. Users must remove clothes promptly. ESC
Entranceways must be kept absolutely free from any obstruction at all times from personal property/furniture. This includes, but is not limited to, benches, plants, bicycles, sports equipment, strollers, boots, etc. Daily Fine
Moving hours and conditions are as follows: ESC
Moving (in or out) will only be permitted between the hours of 8:00 a.m. and 6:00 p.m. unless written permission is obtained from the Manager or Executive Board.
Moving or delivery vans or trucks are not permitted to cross lawns, sidewalks or walkways and must load and unload from the parking area.
The Unit Owner shall pay the cost of any damage caused to the Common Element areas caused by the move and/or movers.
Moving vans, pods or other moving equipment are not permitted to remain on premises overnight, unless prior written approval is received from the Manager or Executive Board.
No one shall make or permit noise or odors to unreasonably disturb or annoy other Unit residents. No one shall unreasonably interfere with the rights, comfort, or convenience of the occupants of other Units. Abusive, profane language, or threatening behavior directed towards any resident, staff member or assigned contractor or contractor’s employee, is strictly prohibited. ESC
All residents are responsible for trash and recycling being carefully deposited inside the dumpsters provided. All refuse and garbage must be placed in plastic bags, securely tied, and placed in the trash bins that are provided by the Association for such purposes. Cardboard boxes must be broken apart, folded and neatly deposited into recycling dumpsters only. Specified recyclables only, must be placed in the proper recycling bins; not trash bins. Burning of trash or refuse is prohibited. Cigarette butts and other litter are not to be thrown on any part of the Common Element areas, including driveways. ESC
Unit owners/tenants shall make their own arrangements for disposal of construction materials, old carpet, furniture, mattresses, tires, appliances, electronics, and other large/bulk items. These items SHALL NOT be placed in or next to the dumpsters. Dumpsters are for bagged trash and permitted recyclables only. $200
The storage, use and/or discharge of fireworks and firecrackers are specifically prohibited anywhere on the Meadows Property, including roadways, parking areas or lawn areas. ESC
Firearms, air rifles, air pistols, bows and arrows, B-B guns and any other weapons are prohibited from use on the Common or Limited Common Areas. ESC
Door-to-door solicitation is not permitted, except by written permission of the Community Manager. ESC
No one is permitted to post notices and/or flyers of any nature in or on the Common Elements, except with prior approval of Management. ESC
Unit Owners are responsible for their conduct and behavior, including any damage caused to the Units, Common Elements, Limited Common Elements or Reserved Common Elements.
Section 2. USE, CARE, MAINTENANCE / ARCHITECTURAL
Units shall be used for private residential purposes only.
In accordance with Article VI, Section 6.1 d. of the Bylaws, in the event of a violation of the Governing Documents, the Association reserves the right to enter the Unit in which, or as to which, such violation or breach exists and summarily to abate and remove, at the expense of the defaulting Unit Owner, any structure, thing or condition that may exist therein contrary to the intent and meaning of the provisions hereof, and the Executive Board shall not thereby be deemed guilty in any manner of trespass. The Executive Board intends to provide notice if possible. In the event of an emergency, or failure of the Unit Owner to arrange for access after request, forced entry, and the cost of such entry will be the expense of the Unit Owner, unless you have provided Management with a duplicate key or keys to your lock or locks.
Interior structural changes, or replacement of exterior doors or windows, or air conditioning units, are allowed only with prior written approval of the Executive Board and the Architectural Review Committee. This includes additions or changes to electrical or wiring, plumbing, gas, HVAC, carpentry, walls, floor coverings, ceilings, stairs or stair coverings. Storm or screen doors on front entry are not permitted. Forms, which must be submitted by the Unit Owner prior to any work include the Architectural Request Form, Certificate of Insurance, Release Agreement, and copies of any necessary Township permits. Anyone making these changes without approval may be required to restore to original. Please submit Architectural Review form to Management office at least 60 days in advance. (For emergencies, please contact Management.) $200+$25
Window coverings and other window treatments shall consist of curtains, draperies, shades, or blinds and shall be of white or cream or lined in white or cream, in order to maintain an aesthetic appearance from the Common Element areas. This rule applies to all units. Daily Fine
No window air conditioners are permitted in any Unit. Window fans are permitted on the inside of window screens only. Daily Fine
No siding or trim of building exteriors, or trim around windows, screens, or doors may be painted or changed in any way. ESC
Front doors must be painted to match all other front doors at Meadows. When you are repainting, please use paint chips to match color. ESC
No permanent carpeting may be installed on decks. Seasonal rugs which become wet from rain should be dried before returning to deck floor. Owner is responsible for cleaning and sealing the flooring of decks and patios. Fencing or barriers of any kind are not permitted. Daily Fine
Nothing shall hang on or from decks or patios except window boxes. Window boxes must not hang outside or set upon the top of the railing of the deck. No one shall hang, sweep, shake or throw anything off patios/decks or out of windows, or doors onto the Common Element area (except careful removal of snow). Deck railings shall not be used for sitting purposes. Only patio furniture and seasonal plants will be permitted on decks and patios. Potted plants must have trays underneath to catch extra water. No exterior awnings shall be placed on windows, patios/decks. Sunscreens or privacy screens on patios/decks must have written permission from the Executive Board and Architectural Review Committee. Daily Fine
Contractors or workmen employed by a Unit Owner or tenant, and Unit Owners or tenants shall be permitted to work in any Unit, or in any Common Element area between the hours of 8:00 a.m. and 6:00 p.m., Monday through Friday, only (except for emergency repairs). Permission for work at other hours must be arranged in writing with the Property Manager. Contractors or workmen must park in an unmarked (guest) parking spot, not in a numbered space or on/along the roadway. Daily Fine
No new washer or dryer installations will be allowed in units. Existing washers or dryers or dryer vents in units may be replaced if they meet specifications and approval by the Architectural Review Committee and the Executive Board. $200
Gas clothes dryers are prohibited. $200
Waterbeds and/or hot tubs are not permitted in units. Daily Fine
No hazardous, combustible, or dangerous materials of any kind may be kept or stored in units or anywhere on the common elements. This includes propane tanks of any size. Daily Fine
The use of kerosene, kerosene heaters, electric heaters, propane heaters, space heaters of any type, or gas generators, is strictly prohibited (non-C02 emitting lithium battery generators are allowed with the approval from The Meadows Management and the Executive Board). Daily Fine
Use of charcoal barbecue grills is allowed providing operation is in an open area, at least ten (10) feet from the building and overhanging decks. A working fire extinguisher must be on hand, and the fire attended to at all times. Flames from barbecue grills shall not exceed six (6) inches. Gas grills are not allowed. Bonfires, fire pits, chiminea, etc. are not allowed. Daily Fine
Charcoal may be stored on patios/balconies if kept under the hood of barbecue equipment or stored in a decorative container of subdued color. $25
Doormats specifically designed for that purpose only may be placed outside of your unit door. Rug remnants, and other miscellaneous articles in lieu of a doormat are strictly prohibited anywhere on the common ground. $25
No toys, bicycles, baby carriages, tools, playpens, wagons, vehicles, benches, chairs, or other personal property shall be permitted, or left on the Common Element areas or entranceways, or stored on patio/balconies overnight. $25
Walls or ceilings of patio or deck areas must be maintained with the same materials and paint as original. Owner may be required to restore to original. ESC
Seasonal decorations are permitted. No extension cords are allowed in entryways. No lights or other decorations may be hung from trees or shrubs. Decorations may not be displayed in front of other Units’ windows or doors, or near entry doorways, without express permission of unit owners. Residents are responsible for the removal of such decorations on a timely basis. $25
Section 3. COMMON AREAS USE
Unit Owners are responsible for seeing that their tenants, residents, occupants, and guests, observe the Rules and Regulations pertaining to noise, conduct, recreation areas, etc.
Unit Owners, tenants, residents, occupants and guests are prohibited from engaging in recreational activities in or around dumpsters, parking areas or within roadways. $25
Car washing is prohibited. ESC
Any planting of annual, or perennial flowers, or ground covers to Common Element area grounds, or removal or trimming of trees or shrubs must have written permission from the Management Office and the Executive Board. No trees or shrubs may be planted in gardens or other Common Element areas without permission of the Executive Board. Upon installation, approved trees or shrubs then become the property of the Association and may be removed, trimmed, or transferred by Management or Association vendors as deemed necessary by the Executive Board. Owners who plant annual or perennial flowers or ground covers shall be responsible for maintenance, watering, pruning, weed removal, and removal of annuals at the end of the season. Plants must be kept within the confines of the garden area, and may not overhang sidewalks, lawn areas, or hang over retaining walls. ESC
No sign, including sales or “for rent” signs, notice, advertisement, decorative flags, banners, or the like shall be inscribed, or exposed on or at any part of any unit, nor shall anything project out of any unit without written approval of the Executive Board, with the exception of seasonal decorations, which must be removed at the end of that season and the U.S. American flag and Commonwealth Flag. Military flags on military holidays may be displayed in accordance with the provisions of the Pennsylvania Flag Act. $25
One (1) “Open House” signs in an appropriate location near the property being offered for sale, and one (1) at the community entrance, may be displayed between the hours of 11:00 a.m. and 5:00 p.m. on the day of the Open House only. $25
Erection of any outside aerial, wires, equipment in connection with any radio or television, or making any other outside installations will not be permitted on the common areas, including building siding, roof or landscaped areas. However, satellite dishes or antennae may be installed on patios or decks, or inside windows. $200
No addition or modification of decks or patios is permitted. Pavers, steps, walls, permanent planters, fences, etc. are not permitted in the Common Element area. $200 and may be subject to restoration to original configuration.
Any modification of Common Element areas or Limited Common Element areas, such as cutting into existing ducts, pipes, vents, etc., is strictly prohibited. $200
Bird feeders are be permitted outside individual units, at the rear of the building. Bird feeders may not be hung near walkways or neighbors’ windows. Ground level feeders should be hung from “shepherd hooks” at least 6’ high, and have a squirrel baffle. Seed debris shall be cleaned up. If the feeders and the area around them are not well maintained, the Association reserves the right to require removal of the feeders. $25
Section 4. STORAGE
Each Unit is allowed only one storage bin where available.
The storage bin must be registered with the Management Office through a signed “Storage Release Form.” The Meadows Condominium Association will not be responsible for loss or damage to any items stored in storage bins. $25
The storage bin must have a label on the face of the storage bin door showing the Unit number and name of designee. $25
No flammable, combustible or illegal articles may be stored in the bins, including but not limited to, propane, tanks, gasoline cans, tires, lighter fluid, fireworks, animals, etc. $100
No articles may be stored in the aisles. Anything left in aisles will be confiscated and disposed of without any notice. $25
Violations of the above rules may result in the removal of the lock, and/or removal of stored articles and a reassignment of the bin after notice and an opportunity to be heard
Section 5. TRAFFIC AND PARKING
The speed limit is not to exceed 15 M.P.H. Unit owners, tenants, their families, their employees, contractors, and visitors, shall obey all Condominium traffic regulations. $50
Failure to come to a complete stop at a stop sign is prohibited. $50
Unit owners, and their tenants, will be allowed to park vehicles which are regularly in use by residents of that Unit on Meadows property. All vehicles must be registered with the Meadows office, and have a Meadows parking tag. One numbered parking spot will be assigned to each unit. Additional cars must be parked in unmarked (“guest”) parking spaces only. The board may limit the number of parking tags per unit in the future based on space availability. Unauthorized vehicles, and all vehicles without a Meadows permit that remain unmoving for more than one week, may be towed from the Meadows property at the owners’ expense. Daily Fine
Vehicles must have a current Pennsylvania inspection sticker, and must be in operating condition. The parking of motorcycles on patios or inside of Units is strictly prohibited. Vehicles may not be parked and used for storage or living quarters. Daily Fine
New Pennsylvania residents and owners of vehicles coming from out of state will have twenty (20) days to make application for Pennsylvania title and registration. If any delay is anticipated, the Management Office must be contacted.
Parking or driving of any motorized vehicle on sidewalk, lawns, and/or tended grounds of the Meadows is strictly prohibited. $50
Loading or unloading of moving vans, delivery vans, trucks or cars on sidewalks, lawns and/or tended grounds is strictly prohibited. $100
Parked vehicles must fit within one parking spot (length and width) with room to open doors, and must not inhibit, or block walkways or sidewalks. No vehicle, or load upon a vehicle shall overhang a sidewalk, or walkway. $25
Visitors are permitted to park in unnumbered parking areas. This includes any contractors or workmen. Any vehicle without a Meadows tag parked for more than 24 hours in a visitor spot will require a temporary parking pass from Management. Daily Fine+TOW
Construction dumpsters or Pods or other temporary containers must receive prior permission from Management to park in an unmarked spot for up to 24 hours. $50
Parking of the following vehicles is permitted on property, but must meet the following requirements:
Passenger Car – a motor vehicle designated for carrying eight passengers or less, primarily used for the transportation of persons. Passenger vans included (see 5.14 for detail).
Motorcycles – the vehicle code defines a motorcycle as a motor vehicle having a seat or saddle for the use of the rider, and designated to travel with no more than three (3) wheels on the ground. Motorcycles or motorbikes may use the parking areas and access roads for those purposes only. Parking or storing of motorcycles or motorbikes on any location other than designated parking areas is prohibited.
Van- the van must meet the following standards:
It has permanently installed full-size seating for at least the driver, and three (3) passengers.
It has windows on both sides and in the rear, separated by solid areas of not more than 12”
It is not designed or adapted for use as an office, workshop, or living quarters.
Trucks - three-quarter ton pickup trucks are the maximum size permitted. Vehicle must fit completely in parking space, length and width.
Parking of the following vehicles on Meadows property is NOT permitted: Daily Fine+TOW
Recreational Trailer- a recreational trailer is a trailer designed or adapted and is used exclusively for recreational purposes. This class includes boat trailers, camping trailers, livestock trailers, house trailers, and semi-trailer.
Motor Home- a motor home is a motor vehicle designed or adapted for use as a mobile dwelling or office, including permanently installed sleeping accommodation, carpeting, kitchen appliances, or office furniture.
Trailer- a vehicle designed to be towed by a motor vehicle.
Boats or Snowmobiles.
Off-/Road recreational vehicles.
Any vehicle/motorcycle that is leaking fluid.
Commercial Vehicles are not allowed in the normal parking areas. A limited number of commercial vehicles may be allowed in a designated area depending on space available. These spaces are available on a first come, first served basis. Registration and payment of a fee set by the Executive Board will be required.
Carports are restricted for use by those individuals who hold legal title or rent this space. Vehicles parked in Carports still require a parking permit. Storage of any articles other than motor vehicles is not permitted in Carports. Vehicles are not to extend or use more than their allotted space which is approximately 18’Lx9’Wx8’H. Carports shall be kept in cleaned and in well-maintained condition. Daily Fine
Handicap Spaces- Upon request in accordance to the requirements and verification of eligibility as set forth in the Fair Housing Act (as appropriate), the Executive Board will approve handicapped parking. Upon request and approval as provided above, the Management Office will issue Handicapped parking signage to reserve an appropriate/requested parking space. This assigned Handicap space will serve as this unit’s allotted residential parking space. Due to parking space limitations, and roadway configuration, this space may not be directly adjacent to the Owner’s Unit, although all efforts will be made to secure the closest space possible to the Unit.
Abandoned Vehicle- The Meadows reserves the right to have the following vehicles removed from the Condominium property at the expense of the owner. An abandoned vehicle is a vehicle that:
is inoperable and left on Meadows property for more than one (1) week and/or has remained illegally or in violation of the Declaration, Bylaws or Rules and Regulations on Meadows property for more than one (1) week and/ordoes not have a valid registration plate, and/or inspection sticker, and/or title, and/or had been left unattended for more than one (1) week or along Meadows property and/or is not owned or operated by a resident, owner, or their guest, Meadows contractor, or employee.
Large-scale car repairs are prohibited on the Meadows Property. Minor work lasting four (4) hours or less may be permitted. All work must be done in a manner that is considerate of other Unit Owners, and must be done within one (1) parking space. No electrical extension cords may be used. No oil or other fluids may be drained onto the pavement, parking area, into the sewer system or elsewhere on the Meadows Property. All waste fluids must be disposed of off Meadows Property in accordance with applicable EPA regulations. $50
The Meadows reserves the right to prohibit the parking of any vehicle that could be a safety hazard to either Meadows’ residents, or other vehicles. Parking of a motor vehicle that contains a gasoline tank inside a Unit is strictly prohibited, and there will be no gasoline cans or tanks stored inside the unit. $50
Any residents or visitors to the Management Office, or swimming pool shall park in the non-assigned parking spaces adjacent to building, (300/400).
Parking in fire zones (marked with yellow paint and/or a sign) is strictly prohibited. Vehicles parked in violation of this restriction are subject to towing at the expense of the vehicle owner. $200+TOW
Section 6. PETS
In accordance with Article IX, Section 9.1 f. of the Declaration, the following rules are regulations regarding pets are/were adopted to ensure harmony among all Meadows residents.
Meadows residents are allowed one (1) dog. Owners and tenants having more than one dog prior to May 1, 2019 were previously required to make application to the Executive Board to have their additional dog(s) “grandfathered in”. However, when the additional dog(s) is deceased, or no longer resides with the owner, an additional replacement dog will not be permitted. Cats and ferrets are also allowed, as are pet birds and fish. Please inquire with Management about other pets. All dogs must hold current dog licenses in Montgomery County. Dogs, cats and ferrets must be inoculated against rabies. Copies of the licenses (if applicable) and rabies vaccines must be submitted to the Management Office annually. The Association reserves the right to report any violations of these requirements to the local Animal Control Officer or local law enforcement. ESC
Owners and tenants must register each of their pets annually with the Management Office when the form is provided. These forms will be due in the Management Office as specified at the time forms are sent each year. Any changes throughout the year must be provided in writing to the Management Office immediately. A registration form is available from the Management Office, and is also located as Appendix C at the back of this Rules and Regulations booklet. VISITING PETS must also be registered, and are subject to these Rules and Regulation, and any applicable fees regardless of how brief the stay. ESC
Owners and tenants are responsible for complying with all applicable Upper Providence Township, Montgomery County, and Pennsylvania State Laws concerning immunization and registration of their pets. Contact the Management Office for current information.
Owners, tenants occupants, and their guests must keep their pets on a leash, and in control, at all times when outdoors, or on the Common Element areas of the Meadows. If a pet is found loose on the Meadows property, Management or the Executive Board has the right to contact Animal Control or local law enforcement to take possession of the pet. Pets may be sent to the local animal shelter at the owner or tenants’ expense. $50
Owners, tenants, occupants, and/or guests are not permitted to recreationally exercise their pets, while off leash, on the Common Element Areas of the Meadows Property. $50
Pets are only permitted to urinate or defecate on designated pet areas on The Meadows Property have been established for walking leashed pets, as specifically outlined in Appendix B at the back of this Rules and Regulations booklet. Allowing pets to deposit wastes in other areas other than those herein designated constitutes a breach of these Rules and Regulations. Owners, tenants, occupants, and their guests, are responsible for the prompt removal of their pets’ feces from all Common Element areas, including the designated areas, of The Meadows Property. $25
Owners, tenants, occupants, and their guests may not stake, tie or leave their pets unattended on any part of the Common Element areas of the Meadows property, including Limited Common Element areas such as patios or balconies, or the exterior of Units. $25
Owners, tenants, occupants or guests shall not have pets in, on, or around the recreational areas. $25
Owners, tenants, occupants, and their guests are responsible for ensuring that their pets do not cause an unreasonable disturbance or create a nuisance for other Meadows residents. $25
Any dog or cat causing harm to another animal or biting any human within the Association is cause for a $100 fine, plus possible removal of the pet from The Meadows premises. The Association reserves the right to report any pet attack/bite incidents to the local Animal Control Office and/or local law enforcement.
In accordance with the Fair Housing Act, upon request with verifying information (if applicable), reasonable accommodations may be granted to these Rules and Regulations. Such requests shall be forwarded to the Management Office.
Owners are legally and financially responsible for any and all physical injury or property damage that their pets (or the pets of their tenants, occupants, residents, or guests) may cause to The Meadows Property, Meadows personnel, other Owners, residents, guests, and/or pets and/or by failure to abide by these Rules and Regulations. The Executive Board reserves the right to have a pet permanently removed from the Meadows property upon three (3) days written notice in accordance with Article IX, Section 9.1 f. of the Declaration in the event said pet is determined to have caused or created a nuisance or unreasonable disturbance by the Executive Board.
Section 7. POOL AND RECREATION AREAS
Outside games, sports, and recreational activities are permitted only in designated play areas (the Tot Lot for children 10 years and under, ) provided for such purposes and are not permitted on tended lawn areas. See Appendix B for specific areas. Warning; $25
The noise level from voices, radios, etc. must be kept at a level so as not to disturb other neighbors; Warning; $25
No alcoholic beverages or illegal drugs are permitted in, on or around any recreational areas (NO LETTER OF WARNING). Immediate fine of $25 for the first offense, $50 for second offense, and suspension of privileges for season for third offense.
No pets are allowed in designated pool and recreational areas. $25
No flying of drones or hobby aircraft is allowed on Meadows grounds. $25
No glass bottles or containers are permitted in recreation areas. $25
Containers will be provided for trash in the pool area. These containers must be used. No trash is permitted to be left in the pool area. $25
No running in pool area. $25
No horseplay, excessive splashing, pushing or dunking. $25
Equipment such as masks, fins, snorkels, or floats may be prohibited at the discretion of the lifeguard.
Two pool passes will be issued to Meadows residents in good standing, at no charge, on an annual basis. This pass must be carried when using the pool. Meadows residents must sign in, and leave their pass with the lifeguard until they are ready to leave the pool area. If the pass is lost, please request a replacement from Management Office during normal office hours. IDs may be requested by the lifeguard on duty.
The pool pass must be used to gain access to the pool area, whether or not you are swimming.
Guest passes may be purchased from the office. Only adults may bring guests, with a limit of four guests per unit per day. All guests must be accompanied by a full-time Meadows resident in good standing. All residents must sign in, and sign in for their guest(s), and enter a unit number. Photo IDs may be requested by the lifeguard.
Guardians who may be accompanying children to the pool may be assigned one of the Unit’s pool passes at the beginning of the season, and will not need to be signed in with the unit owner.
Children five (5) years of age and under will be admitted at no charge, but must be accompanied by a competent guardian in the pool area and in the pool.
Children under (12) years of age are not permitted in the pool area unless accompanied by a competent guardian. However, children between the ages of ten (10) and (12) twelve years of age will be permitted in the pool if they pass a swimming test given by the lifeguard*. The Test will consist of swimming the length of the pool, floating on their back, and treading water in the deep end for one (1) minute. (* Pending availability with current pool service.)
Children will not be permitted in the deep end of the pool unless accompanied by a competent guardian, or have successfully passed the swimming test given by the lifeguard.
Smoking or vaping is strictly prohibited in the pool area. Cigarette butts must be disposed of in appropriate receptacle outside the pool area. $25
When weather dictates that the pool should be closed in the interest of safety, the lifeguard, under the direction of Management, is responsible, and is authorized to clear and close the pool area.
Proper bathing attire must be worn.
Private pool parties are not permitted. Parties being held in the Community Room are prohibited from using the pool. $200
No one is permitted in the pool or in the pool area unless it is attended by a lifeguard. $25
To ensure maximum attention to the pool area safety by the lifeguard, members shall not converse with lifeguards on duty unless related to immediate pool area safety issues.
Lifeguards may use their judgement to determine whether individuals swimming have become over-fatigued, or chilled. The lifeguard may direct any person to take a rest period if excessive fatigue or chill is observed.
Competent guardians are solely responsible for child (ren) at all times while within the pool gate. Children are not under the supervision of the lifeguard. A responsible person must accompany non-swimmers using swimming aids in the water.
Spitting of water and/or other similar unhygienic actions will not be permitted at the pool. $25
All non-toilet trained children and/or incontinent adults must wear swim appropriate diapers or undergarments when using the pool.
No bicycles, skateboards, skates, or any recreational vehicles with wheels are permitted in the pool area.
Climbing over the pool fence at any time, day or night, when the pool gate is locked, and no guard is on duty carries a $100 fine and loss of pool privileges for the season. Complaint will also be made to the appropriate law enforcement officials and trespassers, resident or non-resident, will be prosecuted to the fullest extent of the law.
The lifeguard is completely in charge. He/she may dismiss from the pool area, any person(s) who violate these regulations, exhibits inappropriate or unlawful conduct, or fails to show evidence of the right to use the pool.
No one shall scream, yell or use profanity, or engage in any threatening or harassing conduct, directed at the lifeguard. Doing so will result in an immediate $100 fine, no warning letter.
ANY PERSON REFUSING TO ABIDE BY THE RULES AND REGULATIONS SET FORTH MAY
BE BANNED FROM THE PLAY AND POOL AREAS.
Section 8. COMMUNITY ROOM
Community Room may be rented for gatherings that DO NOT involve alcoholic beverages. $200
Conduct of persons using the Community Room facility, will be governed by the Rules and Regulations of the Condominium, and common courtesy, with regard to time, (no later than midnight) length of party, noise, language, and physical control of all individuals. The resident will be responsible for any and all damages to the Community Room (and other Common Element areas), and is solely responsible to ensure that all guests obey the Rules and Regulations of The Meadows Condominium. $50
Violations of these Rules and Regulations will result in the recovery of adequate funds to restore the room to its’ original condition. A $100 refundable deposit is required of the individual(s) renting the Community Room. If the damage is greater than $100, payment of the remaining damage amount is to be made to The Meadows immediately.
Participants of events held in the Community Room are not allowed to use the pool. $200
The room and fixtures must be returned in the same condition as given; clean, with no damage to the physical property. This also includes rest rooms.
The Community Room key must be returned by 9:30 a.m. on the next business day following the last day of use.
Owner renting this room will indemnify, defend and hold harmless the Association, Board Members and Management from any and all loss, cost, claim, injury, damage or liability sustained or incurred by such Occupants, resulting therefrom, or arising out of or incident to use of the Community Room.
Section 9. GUEST ROOM
The Guest Room facility is to be used as temporary lodging (two week maximum unless period extended by Executive Board Approval) for Meadows Owners or tenants, or guests of a Meadows Owner or tenant.
There is a $100 refundable deposit required for the use and occupancy of the guest room. If upon inspection, and return of the key, the room is found in good order the deposit will be returned. Damages or removal of condominium property will be cause for retention of the deposit, and any damages that exceed the deposit are the sole responsibility of the Meadows Owner/tenant. The key must be returned by 9:30 a.m. on the next business day following the last day of use.
The Owner will be responsible for any and all damages done to the Guest Room, and is responsible to ensure that all guests obey all Rules and Regulations of the Meadows Condominium.
Owner renting this room will indemnify, defend and hold harmless the Association, Board Members and Management from any and all loss, cost, claim, injury, damage or liability sustained or incurred by such Occupants, resulting therefrom, or arising out of or incident to use of the facilities and/or from any act or omission of any of the Indemnified.
Section 10. LEASING CONDITIONS, REQUIREMENTS AND RESTRICTIONS
All Owners that rent their units to tenants, shall be obligated to keep the Units in good order and repair, and in harmonious condition at all times. This includes nuisance, damage, and pet control, as spelled out in the Governing Documents. Daily Fine
All investor/Owners must notify the Management Office within 10 business days of the date their Unit is vacated. Non-compliance will result in a $100 fine. If a Unit is vacated, resulting in damage to Common Elements or an adjacent Unit, the investor/Owner will be responsible for all damages and repairs.
Owners and tenants are responsible to keep each other, and the Management Office informed of any potentially hazardous or hazardous in-Unit maintenance related problem. ESC
All Investors/Owners must register their tenants(s) for pool privileges, if you are choosing to relinquish your pool privileges to your tenants(s). Your tenant will not receive a Pool Season Registration Form from the Management Office. It is the Owners responsibility to complete and return the pool form for their tenant(s).
In order to account for the financial and administrative burden to the Association and Property Management associated with the maintenance of lease files, move-in and move-out expenses, as well as the administration of the affairs of the Association relative to tenants and non-owner occupants, all investor/Owners are required to purchase a Rental Package from the Management Office for each new tenant. The $110 fee is due at time of pick-up.
All Investors/Owners must provide tenants with full and complete copies of the Governing Documents (Rules and Regulations, Declarations, and Bylaws), as amended. Failure to do so will result in a fine of $75.
All Owners who rent their Units shall complete, sign and provide the Meadows Lease Addendum, and the Lease Information Form, together with a copy of the executed lease, at least 5 days prior to tenant move-in. To the extent that any terms or conditions of the lease conflicts with the Governing Documents, the terms and conditions of the Governing Documents shall prevail. Leases that do not conform to the requirements of the Governing Documents may be denied as to form only. Failure to submit the leasing documents will subject the owner to an initial $200 fine and subsequent daily fines.
For any lease amendments or modifications, a copy must be provided to the Association within ten (10) days of its execution.
Subleasing or assignment of a Unit is not permitted without the express written approval of the Executive Board, and any sublease or assignment executed without such approval will be null and void.
No alterations or improvements to the exterior of the Unit or additions or changes to electrical or wiring, plumbing, gas, HVAC, carpentry, walls, floor coverings, ceilings, stairs or stair coverings may be taken unless submission to and prior written approval of all required applications and documentation is received by the Unit Owner in accordance with Article III, Section 2.3 of these Rules and Regulations.
No lease term shall be for an initial term of less than twelve months. Other than a monthly renewal term for a lease with an initial term of twelve months or more, no short-term leasing is permitted. No transient tenants may be accommodated in any Unit.
No owner, tenant, subtenant or licensee may enter into a lease, sublease, assignment or license for less than all of a Unit.
All units are to be used only as a single-family residential dwelling, and the maximum number of individuals who shall be entitled to lease or occupy any unit shall not be greater than the maximum permitted by any applicable ordinance, code or regulation.
Unit Owners shall promptly reimburse in favor of the association all fees, fines, or charges levied by the Association with respect to a tenant, subtenant or licensee, as well as their guests, if not paid by the tenant subtenant or licensee within 30 days.
Delinquent assessments, fees, fines, or other charges shall be enforceable and collectible from the Unit Owner and/or tenant, subtenant or licensee in the same manner as assessments under the applicable provisions of the Declaration, Bylaws, Rules and Regulations and the Uniform Condominium Act.[JAL1]
[JAL1]Delinquent assessments, and charges are the sole responsibility of the Owner of the Unit.
